Below are the details of our Terms and Conditions. We adhere to the guidelines
set out in the Consumer Protection Distance Selling (CPDS) Regulations
2000. The information below provides you with prior information required
by this regulation. Your statutory rights are in no way affected by
these Terms & Conditions.

We are more than a website. Sweet Memories is a traditional Georgian
Sweet Shop based on the Main Street of Inveraray, Argyll. Visitors are
welcome to the shop any day of the week and orders can be picked up.
Thousands of visitors flock to Inveraray each year and we look forward
to extending a warm Scottish welcome to you.
Our Guarantee:
If you are unhappy with your purchase we will replace or refund the items
concerned at our discretion. This does not affect your statutory rights
as a consumer. Please inform us of any problems within 7 working days
of receiving your order. Please e-mail or call us for an immediate resolution
of the problem. We are unable to refund special orders and items not
available on our website.
If your order is to be returned for a full refund, we do not accept liability
for the return carriage costs incurred. If the order is to be refunded
we will issue a refund within 30 days. However, if returning faulty goods
we will issue a refund for the return postage costs incurred. When returning
goods please ensure that the products are unopened, please also include
the following items, your invoice number and purchase date. Without this
information we will be unable to process your refund.
Any goods deemed to be perishable will not be refunded as per the CPDS.
In such instances, we shall have the right to refuse the return if in
our opinion it is not justified. Under these circumstances, the goods
will be returned to you at your cost. Any 'non faulty' goods returned
for a refund will be refunded minus delivery, return delivery and a transaction
cost.

Acceptance of Terms & Conditions of Sale
By placing an order for goods at Inveraray-sweets.com, you are deemed
to have accepted our terms and conditions as governing your order. If
you do not agree to all the terms and conditions specified here, do not
order from Inveraray-sweets.com. We reserve the right to change the Terms & Conditions
from time to time, and post a new version on this website. The new version
will take effect from the time of posting on the site.
Items out of Stock
We only advertise products on our website if in stock. However sometimes
items can go out of stock very quickly due to exceptional demand and in this
case we may not be able to amend the website quickly enough. If you have ordered
an out of stock item, we will generally hold your order if we expect a delivery
within 3 days. If the item will take longer to obtain, we will inform you of
the delay and give you the choice to either cancel the order or wait.
Nut and Other Foodstuff Allergies
Please note that many products are produced in an environment where
nuts are sometimes present therefore we are unable to guarantee our products
will be nut free. Many manufacturers use the same production lines for a number
of products for example, so it is not possible to guarantee that any product
is free of any particular ingredient.
Out of stock or discontinued items
We reserve the right to substitute at our discretion any product that
may be unavailable at the time your order is processed with items of
an equal value.
Packaging of products shown website
On rare occasions goods you receive may not arrive in the same packaging
as the illustration on the Inveraray-sweets.com website.
Prices
All prices shown are in UK Pounds, VAT is included in the price. We reserve
the right at any time to revise prices. We will take all reasonable steps
to notify you of any relevant price change before processing your order.
Payment are made by credit or debit card via PayPal secure checkout system.
We never see or store your credit / debit card details.
Delivery Time
We currently offer delivery to the UK only. We aim to dispatch your sweets
as soon as possible. All sweets orders are sent out Monday to Friday.
No orders are despatched over the weekend. Orders received over the
weekend and bank holidays will be sent the next working day.
Delivery - Royal Mail and Parcelforce48
Royal Mail will attempt to deliver your order once, after that
you are expected to collect your parcel from your local sorting office
within 5 days.
Parcelforce will attempt to deliver your item twice. If you were out
the first time, delivery will be attempted the next working day. If you
would like to collect your parcel instead please contact Parcelforce
by using their collect option on the Parcelforce website.
We will take all reasonable steps to deliver your order in good time.
However, we will not be under any liability to you in respect of failure
to deliver within any timescale or on any particular day or dates.
Title to the goods
Title to the goods passes once your consignment is delivered. Goods
may be collected in person from our shop in Inveraray. Customers must provide
a full delivery address and postcode where the order can be accepted and signed
for. i.e. your home, neighbour's or your workplace. By using the services provided
by inveraray-sweets.com you agree to not hold inveraray-sweets.com responsible
for any late delivery.
Missing Royal Mail delivery
Royal Mail class parcels as missing once 15 working days have elapsed
from the expected delivery date. If you feel your order has been lost
in the post you must e-mail us stating that your order has been lost
in the post and please include all the following information, your invoice
number, payment transaction number and purchase date. Once your parcel
is deemed missing we will either issue you with a full refund or replacement
goods at our discretion.
Missing Parcelforce48 delivery
If you feel your order has been lost by Parcelforce48 you must e-mail
us stating that your order has been lost. Please include all the following
information, your invoice number, payment transaction number and purchase date.
Once your parcel is deemed missing we will either issue you with a full refund
or replacement goods at our discretion.
Missing outside the UK
Royal Mail class parcels as missing once 15 working days have elapsed

Incomplete or Incorrect Delivery Address
It is the customers responsibility to provide a full and correct delivery
address including the postcode. Inveraray-sweets.com will not be held
responsible for orders which become lost due to an incomplete or incorrect
delivery address. If your order is returned to us due to this reason
and you do not want your order to be redelivered, you will be refunded
minus delivery, return delivery and a transaction fee. Redelivery is
£12.98 for Parcelforce48.
Force majeure
No Party shall be liable for any failure to perform its obligations
where such failure is as a result of Acts of Nature (including fire, flood,
earthquake, storm, hurricane or other natural disaster), war, invasion, act
of foreign enemies, hostilities (whether war is declared or not), civil war,
rebellion, revolution, insurrection, military or usurped power or confiscation,
terrorist activities, nationalisation, government sanction, blockage, embargo,
labour dispute, strike, lockout or interruption or failure of electricity [or
telephone service], and no other Party will have a right to terminate this
Agreement in such circumstances .
Jurisdiction
The contracts for the sale of goods or services by inveraray-sweets.com
from the website shall be exclusively subject to, governed by, construed and
interpreted in accordance with Scottish law. The courts of Scotland shall have
exclusive jurisdiction in respect of them and any disputes or claims arising
out of or in connection with them. Our liability to you whether for breach
of contract, misrepresentation, negligence or otherwise shall in no circumstance
exceed the price charged to you for the damaged, defective which give rise
to such liability. Inveraray-sweets.com shall have no liability for any indirect
or consequential losses or expenses suffered by you, however caused. The contract
is concluded once the goods have been received. In the event we are unable
to comply with our obligations due to circumstances beyond our reasonable control,
we shall not be liable for such inability to comply with our obligations or
resulting delays.
Privacy Policy
We don't like 'junk mail' either, so we guarantee not to pass your
details onto any third parties whatsoever. We hold your details purely for
the purposes of shipping your sweets to you.

We aim to deliver the highest level of customer service. However, if
you feel you would like to complain about any matter please e-mail our
support staff at [email protected]. We will reply as soon as
possible.
